Negligence

How do you know if the accident in Richmond Windsor was the result of another person's negligence? Negligence can be defined in many ways including 'the failure to do something which a reasonable person, guided by ordinary considerations would do; or the doing of something which a reasonable and prudent person would not do'. In practical terms in order to prove negligence in a Richmond Windsor car accident compensation claim it is necessary to establish a duty of care which does exist between all road users, to thereafter show a breach of the duty of care by establishing that one party failed to exercise a reasonable degree of skill and care and then to show that the breach of the duty of care directly resulted in the personal injury and loss that is the subject of the car accident compensation claim.

Compensation

Compensation awards are placed into two main categories being ‘special damages’ and ‘general damages’. Compensation that is easy to calculate accurately is called special damages which can generally be proven by production of estimates, bills and receipts. Special damages include lost wages, medical expenses, the cost of repairs to your vehicle etc. General damages represent compensation that cannot be calculated mathematically and must be assessed by a judge which includes the award for the pain and suffering of the injury.

Time Limits

It is important to remember that a three year limitation period applies to a Richmond Windsor car accident compensation claim. That means that you have three years from the date of the accident to settle your claim or have a solicitor begin proceedings in a court of law. If you have not done one of these things by the three year anniversary of your accident, you are no longer able to pursue a claim. There are some exceptions to this rule :-

  • time doesn’t run until the victim is 18 years old
  • time doesn’t run against a mentally disabled person
  • time only runs from the injury becoming obvious
  • time does run if a judge says it doesn’t
