Time Limits

You must satisfy important criteria relating to time if you want to have a successful car accident compensation claim. First, your accident in Nowra Bomaderry must have occurred in the last three years. If your case is not settled or a solicitor has not issued proceedings in a court of law by the three year deadline, then you will not usually be able to pursue a personal injury compensation claim. There are some exceptions to the general three year rule :-

  • if you were injured as a minor then the three years does not start to run until you reach 18 years old
  • time does not run against a mentally disabled person until full mental capacity is attained
  • time does not usually run against a hidden injury until positive diagnosis
  • time does not run if a judge says it doesn’t

Negligence

As well as occurring within the last three years, the accident must be the result of another person's negligence :-

  • a defendant must owe the claimant a duty of care - all road users owe each other a duty of care
  • the duty of care must be breached by a lack of skill when compared to a prudent driver
  • the injury must be directly caused by the breach of the duty of care

Evidence

Evidence is necessary to prove your claim. One of the first things you should do is write down and record all of the information you possibly can, immediately after the collision. Obtain the other driver's full name and contact information. Write down the names and phone number of any witnesses. Note the location of the accident and the damage done to all vehicles involved. Take photographs of the location, the damage to the vehicles and any visible injury.

If you are hurt, you should go to a hospital or doctor's surgery as soon as possible. This will create further evidence in the form of medical records. These records will be necessary later to prove the extent of your injury. You should also keep all estimates, receipts and invoices.
